Terms of Service

Welcome to GalaxyFocus! These Terms of Service ("Terms") govern your use of the GalaxyFocus mobile application ("App") and related services ("Service") provided by sezaienesyildizhan ("we," "us," or "our"). By downloading, installing, or using our App, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using GalaxyFocus, you agree to comply with and be bound by these Terms. If you do not agree to these Terms, please do not use our Service. These Terms constitute a legally binding agreement between you and sezaienesyildizhan.

2. Description of Service

GalaxyFocus is a mobile focus and productivity application that helps users improve their concentration through gamified focus sessions. The App includes:

• Focus timer functionality (5-120 minutes per session)
• Customizable visual themes with planets and rockets
• Gamification system with coin rewards
• Virtual store for purchasing themes and items
• Progress tracking and statistics
• Tag system for session categorization
• Multi-language support (12 languages)
• Cross-device synchronization

3. Eligibility and Age Requirements

You must be at least 13 years old to use GalaxyFocus. If you are between 13 and 18 years old, you must have parental or guardian consent to use the Service. By using the App, you represent and warrant that you meet these age requirements and have the legal capacity to enter into this agreement.

4. User Accounts and Authentication

4.1 Account Creation

GalaxyFocus uses a passwordless authentication system. You can create an account using your email address and a one-time password (OTP) verification. You are responsible for maintaining access to your email account to receive verification codes.

4.2 Account Security

You are responsible for maintaining the security of your account. You must notify us immediately of any unauthorized use of your account or any other breach of security. We are not liable for any loss or damage arising from your failure to protect your account information.

4.3 Account Changes

You may change your email address at any time through the App settings. Changing your email address will require re-verification through our OTP system.

5. App Functionality and Features

5.1 Focus Sessions

The App allows you to set focus sessions ranging from 5 to 120 minutes. You can customize your sessions with different planets and rockets as visual themes. Focus sessions are tracked and recorded for your progress monitoring.

5.2 Gamification System

You earn coins by completing focus sessions at a rate of 1 coin per 5 minutes of focus time. These coins can be used to purchase items in the virtual store. Coins are non-transferable and have no real-world monetary value.

5.3 Virtual Store

The App includes a virtual store where you can purchase planets, rockets, and other items using earned coins or premium diamonds. Store items are digital content only and have no real-world value.

6. In-App Purchases and Payments

6.1 Diamond Currency

GalaxyFocus uses a dual currency system: coins (earned through focus sessions) and diamonds (premium currency). Diamonds can be purchased through in-app purchases ranging from $2.99 to $34.99. All purchases are processed securely through RevenueCat and your device's app store.

6.2 Payment Processing

All payments are processed by Apple (for iOS) or Google (for Android) through their respective app stores. We do not store or have access to your payment information. Payment processing is subject to the terms and conditions of the respective app stores.

6.3 Refunds

Refunds for in-app purchases are handled by Apple or Google according to their respective refund policies. We do not process refunds directly. Please contact Apple Support or Google Play Support for refund requests.

6.4 Currency Terms

Coins and diamonds are virtual currencies with no real-world monetary value. They cannot be exchanged for real money, transferred to other users, or used outside of the GalaxyFocus App. All virtual currency purchases are final and non-refundable except as required by applicable law.

7. Data Collection and Privacy

Your privacy is important to us. We collect and process your data as described in our Privacy Policy. By using the Service, you consent to the collection and use of your information as outlined in our Privacy Policy.

We collect the following types of data:

• Personal information (email address)
• Focus session data and progress
• Purchase history and preferences
• Device information and push notification tokens
• Usage analytics and app performance data

8. User Responsibilities and Prohibited Uses

8.1 Acceptable Use

You agree to use GalaxyFocus only for lawful purposes and in accordance with these Terms. You are responsible for all activities that occur under your account.

8.2 Prohibited Activities

You agree not to:

• Attempt to hack, cheat, or exploit the App's systems
• Use automated tools or scripts to manipulate the App
• Share your account credentials with others
• Reverse engineer, decompile, or disassemble the App
• Use the App for any illegal or unauthorized purpose
• Interfere with or disrupt the App's servers or networks
• Attempt to gain unauthorized access to other users' accounts

9. Intellectual Property Rights

9.1 Our Rights

GalaxyFocus and all its content, features, and functionality are owned by sezaienesyildizhan and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our App without our express written permission.

9.2 Your Content

You retain ownership of any content you create within the App, such as custom tags and session notes. By using the Service, you grant us a limited license to store, process, and display your content as necessary to provide the Service.

10. Service Availability and Updates

10.1 Service Availability

We strive to maintain continuous service availability, but we do not guarantee that the Service will be available at all times. The Service may be temporarily unavailable due to maintenance, updates, or technical issues.

10.2 App Updates

We may release updates to improve the App's functionality, security, or user experience. Some updates may be required for continued use of the Service. You are responsible for keeping your App updated to the latest version.

11. Termination

11.1 Termination by You

You may stop using the Service at any time. You can delete your account and all associated data through the App settings. Account deletion is permanent and cannot be undone.

11.2 Termination by Us

We may suspend or terminate your access to the Service immediately, without prior notice, if you violate these Terms or engage in any prohibited activities. We may also discontinue the Service at any time with reasonable notice.

12. Disclaimers and Limitations of Liability

12.1 Service Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

12.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE.

13. Indemnification

You agree to indemnify and hold harmless sezaienesyildizhan from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of or relating to your use of the Service or violation of these Terms.

14. Governing Law and Dispute Resolution

14.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Turkey, without regard to its conflict of law principles.

14.2 Dispute Resolution

Any disputes arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the Turkish Arbitration Association. The arbitration shall be conducted in Turkish, and the seat of arbitration shall be Istanbul, Turkey.

14.3 Class Action Waiver

You agree that any arbitration or legal proceeding shall be limited to the dispute between you and us individually. You waive any right to participate in a class action lawsuit or class-wide arbitration.

15. Changes to Terms

We may update these Terms from time to time. We will notify you of any material changes by posting the new Terms in the App or by sending you an email notification. Your continued use of the Service after such changes constitutes acceptance of the new Terms.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions shall remain in full force and effect. We will replace any invalid provision with a valid provision that most closely approximates the intent of the original provision.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and sezaienesyildizhan regarding the use of GalaxyFocus and supersede all prior agreements and understandings.
